1. Eligibility

You may use BIGBEST only if you are legally capable of entering into a binding contract under the Indian Contract Act, 1872. If you are a minor, you may use the platform only under the supervision and with the consent of a parent or legal guardian.

2. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current and complete information, and to keep it up to date. Notify us immediately of any unauthorised use.

3. Marketplace role

BIGBEST is an online marketplace that enables third-party sellers to list and sell their products to buyers. The contract for the sale of any product is a bipartite contract strictly between the seller and the buyer. BIGBEST is not a party to that contract and does not manufacture, own or control the products listed by sellers, except where a product is expressly identified as sold by BIGBEST.

4. Acceptable use

You agree not to use the platform to:

• upload or transmit unlawful, harmful, infringing or objectionable content;
• harass, abuse or harm another person, or impersonate any person or entity;
• infringe the intellectual property or other rights of any party;
• attempt to gain unauthorised access to the platform or its related systems; or
• engage in any fraudulent, deceptive or manipulative activity.

5. Seller obligations

Sellers must legally own or be authorised to sell the items they list, ensure their listings are accurate and not misleading, and warrant that their products do not infringe any third-party intellectual property or other rights. Sellers are responsible for the quality, safety and legality of the items they offer.

6. Pricing, payments & refunds

All transactions are processed in Indian Rupees (INR). Prices are inclusive of applicable taxes unless stated otherwise. Where a refund is due, it is processed to the original payment method or via NEFT/RTGS as applicable. In accordance with applicable law, a valid PAN may be required for purchases of ₹2,00,000 or more. Please review our Return & Refund Policy for details.

7. Disclaimer & limitation of liability

The platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, BIGBEST disclaims all warranties, express or implied, regarding the products listed by sellers, including as to quality, suitability, accuracy and merchantability. BIGBEST shall not be liable for any indirect or consequential loss arising from your use of the platform or from any bipartite contract between a buyer and a seller.

8. Indemnity

You agree to indemnify and hold harmless BIGBEST INFOTECH PRIVATE LIMITED, its affiliates, officers and employees from any claim or demand, including reasonable legal fees, arising out of your breach of these terms or your violation of any law or the rights of a third party.

9. Intellectual property

All content on the platform, including text, graphics, logos and software, is the property of BIGBEST INFOTECH PRIVATE LIMITED or its licensors and is protected under applicable law. You may use it for personal, non-commercial purposes only and may not reproduce or exploit it without prior written permission.

10. Governing law & jurisdiction

These terms are governed by the laws of India. The courts at New Delhi shall have exclusive jurisdiction over any dispute arising out of or relating to these terms or your use of the platform.

11. General

These terms, together with our policies referenced herein, constitute the entire agreement between you and BIGBEST. If any provision is held unenforceable, the remaining provisions continue in effect. Our failure to enforce any right is not a waiver of that right. We may update these terms from time to time; continued use of the platform constitutes acceptance of the updated terms.
